The talk is devoted to discussion of Russian practice in the field of software patenting.
The first part of the talk discusses who, and for what purpose, might need to patent software. Also, tasks facing software developers, such as identifying new potentially patentable solutions and inventions, forming a patent portfolio, patent searching and potential employer-employee conflicts, are addressed. From the employer’s perspective, issues relating to protection of R&D investment from competitors, litigation defense of sales channel participants, raising company capitalization, and reports to shareholders, are addressed.
The second part of the talk is devoted to various legal aspects of Russian and international patenting of software.
The third part discusses the use of the patent mechanism for regulating the relationship between employer and employee. In particular, situations where the employee refuses to sign documents and/or demands money for signature, are discussed.
The fourth part discusses aspects of use of patents by Russian software companies when approaching international markets.
The fifth part discusses software patents as they relate to business methods. Patenting of Internet-services is also discussed. Various aspects of sale of patents and patent portfolios are also discussed.
